Terms and Conditions

§1 General Provisions

1.1 Scope

These General Terms and Conditions ("Terms") govern the contractual relationship between FEEL THE BARRE ("FEEL THE BARRE", "we", "our" or "us") and all customers purchasing memberships, class packages, products or other services offered by FEEL THE BARRE.By purchasing or booking any service, customers agree to these Terms.

1.2 Eligibility

Customers must be at least 18 years of age to purchase memberships or class packages.Customers under the age of 18 may only participate in designated classes with the written consent of a parent or legal guardian where required by FEEL THE BARRE.

1.3 Bookings

All classes must be booked in advance using the official FEEL THE BARRE booking platform.A space in class is only guaranteed once the booking has been successfully confirmed.

1.4 Personal Use

Memberships, class packages, promotional offers, vouchers and class credits are personal to the registered customer and may not be shared, transferred, resold or exchanged unless expressly permitted by FEEL THE BARRE.

1.5 Timetable & Operational Changes

FEEL THE BARRE reserves the right to amend class timetables, instructors, studios, operating hours and services where reasonably necessary.Classes may occasionally be cancelled or rescheduled due to instructor illness, operational requirements, weather conditions, special events or circumstances beyond our reasonable control.Where a class is cancelled by FEEL THE BARRE, any class credit used for that booking will automatically be returned to the customer's account.

1.6 Studio Closures

FEEL THE BARRE reserves the right to close the studios on public holidays and for up to ten (10) additional days per calendar year for maintenance, renovations, staff training or operational requirements.Such closures do not entitle customers to refunds, compensation or extensions of memberships or class packages.Whenever reasonably possible, advance notice will be provided.

1.7 Personal Training

Personal Training sessions are arranged separately and are subject to instructor availability.Sessions may only take place outside the published group class timetable unless otherwise agreed.

1.8 Memberships, Packages & Gift Vouchers

Customers may purchase memberships, class packages, gift vouchers and other products offered by FEEL THE BARRE.Memberships and class packages remain valid only for the period specified at the time of purchase.Gift vouchers are valid for twelve (12) months unless a different validity period is stated at the time of purchase.Unused credits expire automatically at the end of their validity period and cannot be exchanged for cash or extended unless FEEL THE BARRE expressly agrees otherwise or mandatory law requires it.

§2 Memberships

2.1 General Membership Rules

Memberships provide a fixed number of class credits during each billing cycle.The number of monthly credits and included benefits depend upon the membership selected at the time of purchase.Membership credits cannot be transferred to another person and have no cash value.Unless specifically included within the membership purchased, unused monthly credits do not carry forward into the following billing cycle.

2.2 Membership Benefits

The individual benefits of each membership are displayed on the FEEL THE BARRE website at the time of purchase.These benefits may include, depending on the membership selected:• Monthly class credits• Credit rollover (where applicable)• Priority booking• Exclusive member events• Personal Training sessions• Member discountsFEEL THE BARRE reserves the right to reasonably amend membership benefits provided that the overall nature and value of the membership are not materially reduced.

2.3 Membership Payments

The first payment is collected immediately upon purchase.Thereafter, membership fees are collected automatically every month using the customer's chosen payment method.Customers are responsible for ensuring that their payment details remain valid and up to date.

2.4 Failed Payments

If a payment cannot be collected, FEEL THE BARRE may temporarily suspend access to bookings and membership benefits until all outstanding amounts have been paid.Where multiple payments remain outstanding, FEEL THE BARRE reserves the right to recover the remaining contractual amounts in accordance with applicable law.

2.5 Membership Cancellation

Memberships may be cancelled at any time before the next renewal date.If cancellation is received before the next billing date, the membership will end at the conclusion of the current paid billing period.If cancellation is not received before renewal, the membership will automatically renew for the next billing period.Memberships purchased online may be cancelled through the customer's online account.Memberships purchased directly at the studio must be cancelled in writing by emailing info@feelthebarre.de.

2.6 Membership Pauses

Members may request to pause their membership for a minimum of one complete billing cycle.Pauses must begin on a membership renewal date and end on a future renewal date.Partial-month pauses are not available.Pause requests must be submitted by email at least seven (7) days before the next billing date.Approval remains at the discretion of FEEL THE BARRE.

2.7 Cancellation & No-Show Policy

Customers may cancel bookings free of charge up to twelve (12) hours before the scheduled class.Bookings cancelled within twelve (12) hours of the class will result in the booked class credit being forfeited together with a €5 late cancellation fee.Failure to attend a booked class without cancelling will result in the booked class credit being forfeited together with a €10 no-show fee.Any applicable fees must be paid before future bookings or membership access can be restored.

2.8 Arrival & Late Arrival Policy

To ensure classes begin on time and provide the best possible experience for all customers, we kindly ask all participants to arrive before their scheduled class.

Customers attending FEEL THE BARRE for the first time must arrive at least fifteen (15) minutes before the scheduled class start time to allow sufficient time for check-in, an introduction to the studio and any necessary paperwork.

Returning customers should arrive at least ten (10) minutes before the scheduled class start time.

The latest admission time for returning customers is two (2) minutes before the scheduled class start time. After this time, entry will not be permitted under any circumstances.

This policy applies without exception and is in place to ensure customer safety, maintain the quality of the class experience and allow classes to start promptly.

Late arrival does not entitle the customer to a refund, replacement class, extension of membership or waiver of any applicable late cancellation or no-show fees.

Customers are expected to treat all FEEL THE BARRE staff and instructors with courtesy and respect at all times. Aggressive, abusive, threatening or disrespectful behaviour towards staff or other customers will not be tolerated and may result in refusal of entry, removal from the studio or termination of memberships or future bookings at FEEL THE BARRE's discretion.

§3 Right of Withdrawal

3.1 Statutory Right of Withdrawal

Consumers purchasing services or products online may have a statutory right of withdrawal in accordance with applicable consumer protection legislation.

3.2 Immediate Performance of Services

Where a customer purchases a membership, class package or other service and expressly requests that FEEL THE BARRE begins providing the service before the expiry of the statutory withdrawal period, the customer acknowledges that:

FEEL THE BARRE may begin providing the booked services immediately after purchase.

If the booked service has been fully performed during the statutory withdrawal period, the statutory right of withdrawal expires.

If the customer exercises their statutory right of withdrawal after performance has begun but before the service has been fully performed, FEEL THE BARRE may charge a proportionate amount for the services already provided, where permitted by law.

3.3 Statutory Rights

Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be excluded.

§4 Health & Participation

4.1 Participation

Customers participate in all classes, workshops and other activities offered by FEEL THE BARRE at their own risk.

Each customer is responsible for ensuring that they are physically and medically fit to participate. If a customer has any injury, illness, medical condition or is pregnant, they should seek appropriate medical advice before attending classes.

Customers are responsible for informing the instructor before class of any injury, medical condition or pregnancy that may affect their participation.

4.2 Pregnancy

Customers attending BarrePREGNANT classes must complete and sign the FEEL THE BARRE Pregnancy Liability Waiver before attending their first class.

By participating, customers confirm that they have obtained medical clearance where appropriate and understand that participation is entirely at their own risk.

4.3 Teenagers

Parents or legal guardians of participants under the age of eighteen (18) must complete and sign the FEEL THE BARRE Teenager Liability Waiver before the participant attends their first class.

§5 Liability

5.1 General Liability

FEEL THE BARRE shall only be liable for damages in accordance with the applicable statutory provisions.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, gross negligence or any other liability that cannot legally be excluded.

5.2 Class Cancellations

If FEEL THE BARRE cancels a class due to instructor illness, operational requirements, adverse weather conditions or circumstances beyond its reasonable control, customers will receive either a replacement class credit or a refund where appropriate.

No further compensation shall be payable.

5.3 Personal Belongings

FEEL THE BARRE provides a self-service drop-off area for shoes and outerwear before entering the studios.

This area is provided solely for the convenience of customers. FEEL THE BARRE does not assume custody of any items left within this area.

Shoes, jackets and other belongings left in the drop-off area remain entirely at the customer's own responsibility. FEEL THE BARRE accepts no liability for the loss, theft, damage or accidental exchange of such items except where liability cannot legally be excluded.

Customers are responsible for ensuring that they collect the correct belongings before leaving the studio.

5.4 Lockers

Lockers are provided within the changing rooms for the temporary storage of valuables during classes.

Customers should store valuables inside the lockers provided. FEEL THE BARRE accepts no liability for valuables left outside the lockers.

Lockers may only be used whilst attending classes. FEEL THE BARRE reserves the right to open lockers where reasonably necessary for operational, maintenance or security purposes.

Customers may be charged the reasonable costs associated with replacing lost locker keys, damaged locks or repairing damage resulting from misuse.

5.5 Lost Property

Lost property found within the studios will be retained for a reasonable period where practical.

Items that remain unclaimed may be donated, recycled or otherwise disposed of at the discretion of FEEL THE BARRE.

FEEL THE BARRE accepts no responsibility for unclaimed lost property.

§6 Merchandise & Retail Purchases

6.1 Merchandise

FEEL THE BARRE offers a range of merchandise, apparel, accessories, drinks, snacks and other retail products both online and within its studios.

All products are subject to availability. FEEL THE BARRE reserves the right to amend or discontinue products, colours, sizes and pricing at any time.

6.2 Online Purchases

Customers purchasing merchandise through the FEEL THE BARRE online shop are entitled to the statutory consumer rights applicable to distance selling under German law.

If an item arrives damaged, faulty or incorrect, customers should contact info@feelthebarre.de within fourteen (14) days of receipt, quoting their order number and, where possible, providing photographs of the issue.

Where a claim is verified, FEEL THE BARRE will arrange a replacement, repair or refund in accordance with applicable law.

6.3 In-Studio Purchases

Products purchased directly within a FEEL THE BARRE studio are treated as standard in-store retail purchases.

Returns, refunds or exchanges are not available for products purchased in the studio unless the product was defective at the time of purchase or the customer has statutory rights requiring otherwise.

For hygiene reasons, opened food, drinks and other consumable products cannot be returned unless they are faulty.

6.4 Apparel & Accessories

Customers are responsible for selecting the correct size when purchasing apparel and accessories.

Where applicable, returned merchandise must be unworn, unused, unwashed and returned in its original condition with all original packaging and tags attached unless otherwise required by law.

§7 Data Protection

7.1 Privacy

FEEL THE BARRE processes personal data in accordance with the applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Information regarding the collection, processing, storage and protection of personal data, as well as customers' rights under applicable data protection laws, is set out in our Privacy Policy (Datenschutzerklärung), which is available on our website.

7.2 Customer Information

Customers are responsible for ensuring that the personal information provided to FEEL THE BARRE, including their name, email address, telephone number, postal address and payment details, remains accurate and up to date.

FEEL THE BARRE shall not be responsible for any inconvenience resulting from incorrect or outdated customer information.

§8 Changes to Services & Terms

8.1 Changes to Services

FEEL THE BARRE reserves the right to make reasonable changes to its timetable, instructors, class formats, studio facilities, membership benefits, pricing and operational procedures where necessary for business, operational or legal reasons.

Such changes shall not materially reduce the overall value of an active membership.

8.2 Changes to these Terms

FEEL THE BARRE reserves the right to amend these Terms and Conditions where reasonably necessary due to changes in legislation, business operations, technical requirements or the services offered.

The latest version of these Terms and Conditions will always be available on the FEEL THE BARRE website.

Continued use of FEEL THE BARRE's services following publication of updated Terms shall constitute acceptance of the updated Terms, unless mandatory law provides otherwise.

§9 Miscellaneous

9.1 Force Majeure

FEEL THE BARRE shall not be liable for any delay, interruption or failure to perform its obligations where such failure results from circumstances beyond its reasonable control.

This includes, but is not limited to, extreme weather conditions, government restrictions, pandemics, strikes, utility failures, fire, flooding, natural disasters or any other event beyond FEEL THE BARRE's reasonable control.

Where reasonably possible, affected services will be rescheduled or suitable alternatives offered.

9.2 Severability

Should any provision of these Terms and Conditions be found to be invalid, unlawful or unenforceable, the remaining provisions shall remain unaffected and continue in full force and effect.

The invalid provision shall be replaced, where legally permissible, with a valid provision that most closely reflects its original commercial intention.

9.3 Governing Law

These Terms and Conditions shall be governed by the laws of the Federal Republic of Germany.

Where legally permissible, the place of jurisdiction shall be Berlin, Germany.
