Terms and Conditions

§1 Services, House Rules

1.1 The latest version of the house rules applies. FEEL THE BARRE reserves the right to make changes to the house rules without the consent of the customer, as long as this does not affect the essence of these General Terms and Conditions and the customer is not unreasonably disadvantaged.

1.2 In order to use the services of FEEL THE BARRE, the customer must be of legal age. If the child has not yet reached the age of majority, a written declaration of consent from a legal guardian must be submitted in order to be able to use the FEEL THE BARRE range of services.

1.3 Class hours are booked via the online booking system on the website at  www.feelthebarre.de. A course attendance can only be guaranteed after prior registration via the online booking system. If a course is already fully booked, there is no entitlement to reimbursement of the course fee or membership fee.

1.4 Classes and memberships are personal and cannot be transferred.

1.5 FEEL THE BARRE reserves the right to close on all public holidays and up to a further 10 days a year for renovation or other urgent operational requirements, without the customer being entitled to a refund of course or membership fees. The corresponding dates will be communicated to the customer in good time in advance by means of notices and/or by email.

1.6 Appointments for personal training can only be made by telephone or on site and for the times when no courses are taking place.

1.7 FEEL THE BARRE users can purchase memberships for attending several classes. These packages only entitle you to book classes at FEEL THE BARRE only. The term of the packages is 1, 3, 6 months from the date of purchase. Unused class hours expire after the above term. There will be no reimbursement for unused class hours. The new customer offer and special tariffs are excluded from this. The separately listed conditions apply here.

1.8 FEEL THE BARRE reserves the right to cancel courses at short notice and to change times or trainers. The registered course participants will be informed at least 6 hours in advance by email about the course cancellation, or about the change in time or change of trainers. The booked course hour does not expire, but can be made up for at a later date.


§2 Membership

2.1 Membership entitles you to unlimited or limited bookings of classes per current month. Hours that are not redeemed cannot be carried over to the following month and expire from the hourly account.

2.2 Memberships that have been agreed under special conditions are automatically adjusted to the normal rate after the basic term.

2.3 The monthly membership contract becomes effective with the online booking or booking in the studio. The customer can use the services of FEEL THE BARRE to the agreed extent from the start of the contract.

2.4 The membership fee is due on the date of each month on which membership was acquired. The membership fee will be collected cashless by credit card or debit, unless another payment method has been agreed.

2.5 If the customer is in arrears with more than one membership fee, FEEL THE BARRE is entitled to demand the fee for the remaining term of the contract with immediate due date. If the membership amount cannot be debited at the time of booking due to insufficient funds in the account, which causes a return debit, the customer will incur a return debit fee of €20.00.

2.6 FEEL THE BARRE reserves the right to adjust the membership fees accordingly in the event of changes in the statutory value added tax.

§ 3 Right of Withdrawal

3.1 Packages and memberships purchased online have a 23 day right of cancellation from the time the contract is concluded. If the range of services from FEEL THE BARRE has already been used, the customer must pay compensation if the range of services previously purchased from FEEL THE BARRE has not yet been used.

3.2 Without prejudice to your statutory rights, we grant you a voluntary 15-day right of return on items purchased on our ecommerce shop. To do this, simply return the goods to us within 15 days from the day you received the goods.

3.3 The voluntary right of return applies to all undamaged and complete goods that are brought to us in their original packaging. We ask that you contact us before returning the goods if they do not meet these requirements.

3.4 For the repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you.

3.5 The right of return voluntarily granted by us by contract does not affect your statutory rights. These remain unrestricted and independent of the right of return. In particular, the statutory warranty claims and your right of withdrawal remain unaffected.


§4 Suspension of Membership

It is generally not possible to let the membership rest.

§5 Termination of Membership

5.1 The termination of membership must be in writing.

5.2 Memberships have a minimum term of 1 month. The notice period during the minimum term is 2 weeks at the end of the term.

5.3 After the minimum term has expired, the membership is automatically extended indefinitely. After the minimum term has expired, membership can be terminated in writing at any time with a notice period of 2 weeks to the end of the month.

§6 Cancellations

Courses can be canceled online free of charge up to 24 hours before the start of the course. After that, despite no-show, a full hour will be deducted from the customer's hourly account or €19.00 will be debited.

§7 Liability

7.1 FEEL THE BARRE excludes any liability for damages to the customer, unless otherwise provided by law.

7.2 If classes are canceled for reasons FEEL THE BARRE is not responsible for, there is no entitlement to compensation beyond the reimbursement of a course fee or membership fee.

7.2 FEEL THE BARRE assumes no liability for the loss of valuables. In particular, the provision of lockers does not justify any liability for items brought into them. Lockers can only be used during the time of the respective training session. FEEL THE BARRE is entitled to have misused lockers opened for a fee.

7.3 FEEL THE BARRE is not liable for damage for which the customer is responsible. No liability is accepted for damage caused by improper use of the device.

7.4 Damage to FEEL THE BARRE for which the customer is responsible must be compensated by the customer.

7.5 FEEL THE BARRE reserves the right to demand the submission of a health and safety certificate issued by a doctor in individual cases before using the service offered. This applies in particular in the case of pregnancy, artificial implants, epilepsy, etc.

§8 Data protection, place of jurisdiction and nullity clause

8.1 FEEL THE BARRE is entitled to store, process and transmit the customer's personal data in accordance with §§ 20, 28 BDSG for the execution of the contract. FEEL THE BARRE undertakes to treat as confidential any information from the customer's area that it becomes aware of in the course of the execution of the contract. Changes relevant to the contract such as address, name, bank details (cancellation fees are then borne by the customer), etc. must be communicated to FEEL THE BARRE by the customer immediately.

8.2 These general terms and conditions and membership contracts are subject to German law.

8.3 The place of jurisdiction is Berlin.

8.4 Should individual provisions of these General Terms and Conditions be ineffective or contain gaps, this shall not affect the validity of the remaining provisions. Instead of the invalid provision, the provision that comes closest to what is economically intended shall apply.
